Please read these Terms of Service (“Terms”) carefully before using the G2Scale website (g2scale.com), our services, or any forms, landing pages, or digital assets operated by G2Scale LLC (“G2Scale,” “we,” “us,” or “our”). By accessing our website, submitting information through any of our forms, or using our services, you agree to be bound by these Terms. If you do not agree, do not use our website or services.

G2Scale LLC is a Texas limited liability company that provides marketing, inquiry capture, and inside-sales-assistant (“ISA”) support services. G2Scale is not a licensed real estate broker or sales agent and does not perform activities requiring a real estate license.

SMS Program and Messaging Use Cases

G2Scale operates an SMS program for meeting-related communications. When you book a meeting on the g2scale.com calendar and tick the unchecked SMS consent checkbox, you may receive text messages including meeting confirmations, reminders, recaps, requested information, and conversational replies tied to your active business conversation. Ticking the SMS consent checkbox is optional and is not required to book a meeting.

How to Opt Out

You can opt out of SMS messages at any time by replying STOP to any text message you receive from G2Scale. You will receive a single confirmation message and no further texts will be sent. You will not be charged for replying STOP.

Message and Data Rates

Message and data rates may apply. Standard message and data rates charged by your wireless carrier or internet service provider will apply. G2Scale is not responsible for any charges applied by your carrier.

Carrier Liability Disclaimer

G2Scale will make reasonable efforts to deliver SMS messages promptly; however, carriers may delay or prevent delivery. G2Scale is not responsible for delays, failures, or errors in message delivery by wireless carriers. Carriers are not liable for delayed, undelivered, or misdirected messages.

Age Restriction

G2Scale services are intended only for individuals who are 18 years of age or older. By submitting your information, you confirm that you are at least 18 years old and have the legal authority to enter into these Terms.

1. Definitions

“Client” means a business or individual who has entered into a service agreement with G2Scale to receive marketing, client acquisition, and/or ISA services.

“User” means any individual who submits personal information through a G2Scale-operated form, landing page, advertisement, or other digital asset.

“Services” means the marketing, advertising, client acquisition, inquiry follow-up, appointment setting, and related services provided by G2Scale to its Clients.

“Platform” means g2scale.com and any associated subdomains, landing pages, forms, and digital properties operated by G2Scale.

2. Description of Services

G2Scale provides marketing and client acquisition services on behalf of its Clients. These services include, but are not limited to:

G2Scale acts as a service provider to its Clients. When you submit your information through one of our forms or landing pages, you may be contacted by G2Scale and/or the specific Client identified on that form or advertisement. G2Scale does not guarantee any particular outcome, closing, transaction, or return on investment for any party.

3. Consent to Communications

3.1 SMS Express Written Consent

You provide consent to receive SMS communications from G2Scale through the following method, preserved in evidence:

Your SMS consent covers automated and non-automated text messages from G2Scale relating to your booked meeting, including meeting confirmations, reminders, recaps, requested information, and conversational replies tied to the active business conversation.

3.2 Phone and Email Follow-Up

When you book a meeting through the g2scale.com calendar, you voluntarily provide your phone number and email address so we can hold and follow up on that meeting. G2Scale may contact you by phone and email in connection with the meeting you booked. These communications are not automated or pre-recorded calls and do not rely on the SMS consent checkbox.

3.3 Consent Is Not a Condition of Purchase

Ticking the SMS consent checkbox is optional and is not required to book a meeting or to receive any services from G2Scale. You may book a meeting without ticking the SMS consent checkbox; in that case you will not receive SMS from us, only the phone and email follow-up described above.

3.4 Message Frequency and Rates

Message frequency varies based on your engagement, up to 5 messages per week. Standard message and data rates may apply. G2Scale is not responsible for any charges applied by your wireless carrier or internet service provider.

3.5 Opt-Out and Revocation of Consent

You may revoke your SMS consent at any time by replying STOP to any text message you receive from us. Upon receiving your STOP request, we will send you a single confirmation message and will cease sending further text messages. You may also opt out by contacting us at contact@g2scale.com.

You may ask us to stop calling or emailing you at any time by sending a written request to contact@g2scale.com or by any other reasonable method. We will process your opt-out request within 10 business days.

3.6 Supported Carriers

Our SMS services are supported by all major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

3.7 One-to-One Consent

Your SMS consent applies only to communications from G2Scale. We do not share your phone number, consent, or other contact information with unrelated third parties for their own marketing purposes.

4. AI-Assisted Communications

G2Scale uses artificial intelligence technology to assist with initial inquiry responses and follow-up. When you submit your information, you may receive AI-generated responses designed to address your inquiry, gather additional information, and facilitate appointment scheduling. Human agents also participate in the follow-up process.

By submitting your information, you acknowledge and consent to receiving AI-assisted communications as part of our services. AI-assisted messages are sent on behalf of the Client identified on the form where you submitted your information.

5. Call Recording Disclosure

G2Scale may record telephone calls for quality assurance, training, and compliance purposes. By engaging in a telephone call with G2Scale or its representatives, you acknowledge that the call may be recorded. G2Scale complies with all applicable federal and state call recording laws, including obtaining consent in two-party consent jurisdictions.

We share your information with the specific Client identified on the form or advertisement through which you submitted your information. This Client will use your information to provide the real estate or other services you inquired about. We do not sell your personal information to unrelated third parties. We may share your information with service providers and subcontractors who assist us in delivering our Services (such as CRM platforms, telephony providers, and ISA personnel), and as required by law or legal process.

6.4 Data Retention

We retain your personal information in our CRM system for as long as necessary to fulfill the purposes described in these Terms, to comply with legal obligations, or until our Client relationship ends. Upon termination of a Client relationship, inquiry data is exported to the Client and deleted from our systems within 30 days, unless retention is required by law.

All content on g2scale.com, including text, graphics, logos, images, and software, is the property of G2Scale LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.

You agree not to use our website for any unlawful purpose, to attempt to gain unauthorized access to our systems, to interfere with the operation of our website, or to submit false or misleading information through our forms.

10. Third-Party Platforms and Services

G2Scale uses third-party platforms and services in delivering its Services, including but not limited to Meta (Facebook/Instagram) for advertising, CRM software, telephony and SMS providers, and payment processors. These third-party services are governed by their own terms of service and privacy policies. G2Scale does not control these third-party platforms and is not responsible for their actions, policies, outages, or changes.

Ad platforms may reject ads, restrict targeting, suspend accounts, or change their policies at any time. Telephony carriers may filter, block, or delay messages. G2Scale does not guarantee uninterrupted delivery of any communications through third-party platforms.

11. Disclaimers

THE PLATFORM AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. G2SCALE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

G2Scale does not guarantee any specific number of inquiries, appointments, closings, revenue, or return on investment. Results depend on numerous factors including market conditions, Client actions, ad platform performance, and prospect behavior.

G2Scale is not a licensed real estate broker, agent, or attorney. Nothing on our website or in our communications constitutes legal, financial, or real estate advice.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, G2SCALE LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND SUBCONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, OUR SERVICES, OR THESE TERMS.

G2SCALE’S TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID TO G2SCALE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless G2Scale LLC, its members, officers, employees, agents, and subcontractors from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your use of the Platform, or any information you submit through our forms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles.

Any dispute arising out of or related to these Terms or your use of the Platform will be resolved by good-faith negotiation for fifteen (15) days, followed by binding mediation conducted via videoconference and administered under JAMS Mediation Rules (or a mutually agreed alternative). Each party bears its own mediation costs.

To the extent any dispute proceeds beyond mediation, you agree that exclusive jurisdiction and venue shall lie in the state or federal courts located in Texas.

15. Changes to These Terms

G2Scale reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Children’s Privacy

Our Platform and Services are not directed to individuals under the age of 18. We do not knowingly collect personal information from anyone under 18. If we become aware that we have collected information from a minor, we will take steps to delete it promptly.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with any applicable service agreement between G2Scale and its Clients, constitute the entire agreement between you and G2Scale regarding the subject matter herein. These Terms do not create any third-party beneficiary rights.
